TELUGU INDIAN IDOL S4 - VOTING TERMS AND CONDITIONS

RELEVANT DEFINITIONS

• "Contestant" means the contestants selected to appear and participate in the Show and is eligible to win the Show by receiving votes in accordance with these Voting Rules.
• "Viewer" means any person who has attained the age of eighteen (18) years as on June 1, 2025.
• "Territory of the Program" means Worldwide.
• "Voting Territory" means Worldwide.
• "Voting Mechanism" means the prescribed process and method of casting votes for Contestants on the Show through the Platform.
• "Voting Period" means the time period for which the Viewer shall be eligible to vote in accordance with the Voting Mechanism.

PRINCIPAL RULES

• The Show is a reality singing competition wherein individuals across the Territory are selected as Contestants after being part of various auditions as per the format prescribed by the Producer and on the basis of their performance, calibre, singing techniques, screen presence, interaction with audience and overall personality at every level of the selection process of the Show, the Judges, at their sole discretion, select and shortlist the final Contestants who shall compete against each other in the further rounds of the Show (“Final Rounds”). During the Final Rounds, the Contestant who scored least marks in the Judges' evaluation, will be nominated for elimination each week. The Viewers will then be asked to cast their votes for the nominated contestants only to save from eviction of the Show. The Contestant with the minimum number of votes shall be eliminated from the Show.
• The elimination of the Contestants by the Voting Mechanism and/or decisions made by the Producer in any aspect of the Show/Voting Mechanism shall be considered final and binding on all the Viewers and in no event, shall the Viewer(s) dispute such decisions.
• During the Voting Period, Viewer(s) can participate in the Voting Mechanism for the Show. It is hereby clarified that the employees of the Producer, their immediate family members, their respective agents, subsidiaries, representatives, affiliates as well as the sponsors and promoters of the Show and others associated with the Producer are not eligible to participate in the voting.
• The Viewer(s) hereby agrees that by participating in the voting, the Viewer(s) shall be bound by any decisions made by the Producer in its sole discretion including any interpretations of these Voting Rules.
• The Viewer hereby agrees to provide further information to the Producer and/or the Platform when requested for confirming eligibility such as PAN Card, Aadhar Card and any relevant identification documents as may be required by the Producer and/or the Platform. In the event, the Producer or the Platform finds the Viewer ineligible, or if they have not complied with these Voting Rules, the Producer or the Platform, at its sole discretion, may disqualify the vote (s).
• The Viewer(s) hereby represents and warrants that the Viewer(s) is not under any disability, restriction or any kind of prohibition, which shall prevent the Viewer from performing or adhering to any of the Voting Rules herein and have not entered into and shall not enter into any agreement that may violate the Voting Rules.
• The Producer further has the discretion to change the timings and schedule of the voting lines from time to time.
• In the event of any change in the timing or the schedule of the voting lines, the Producer shall ensure the changes are communicated to the Viewer(s) as and when necessary, on the episode of the Show aired on the Platform.
• Any votes received after or before the defined timelines shall be considered ineligible and therefore shall not be recorded.
• The Viewer understands and accepts that casting of a vote is merely an act to nominate their favourite contestant and no gratification or reward shall be given by the Producer or the Platform or the management of the Show for this voting activity. Viewer shall not make any claims including but not limited to monetary and non-monetary claims, against the Producer or the Platform or the management of the Show or any of its affiliates in respect of any compensation or gratification.
• The Viewer specifically waives his/her right to seek injunctive relief against the Producer, the Platform, its employees or agents or any of its affiliates in relation to the Show, and/or the Voting Mechanism, to the maximum extent permitted by law.
• The results of the recorded votes shall be announced during the telecast of the episode on the Platform, subsequent to the end of the voting period.

VOTING MECHANISM

A Viewer interested to cast his/her vote shall be subject to the following mechanism:

• The Viewer(s) can vote for the Contestants during the Voting Period through his/her AHA account. For registration of the account, the Viewer shall be required to submit information at the time of registration. Any incomplete or erroneous information, shall be considered invalid and deemed null and void thereby rendering the vote of such Viewer ineligible.
• The Viewer will have to open the updated application in Android or iOS device, visit the Telugu Indian Idol tab and click on the Vote Now button for submitting his/her vote through this Voting Mechanism. The Viewers are advised to update the application of the Platform from time-to-time for a seamless experience.
• Subsequent to clicking the Vote Now button, Viewers shall be required to provide Mobile Number to cast their votes.
• The Viewer can cast their votes for a specific Contestant by clicking on the photograph or name of the Contestant. Only a maximum of 50 votes per Viewer and per Voting Period of each episode will be allowed. In the event a Viewer submits over and above 50 votes, the votes will be considered invalid therefore, will be discarded by the management of the Show.

• Voting Cycle and schedule ("Voting Cycle"):

• The Viewer will not be charged in the Voting Mechanism on the Platform however, there may costs levied at the applicable rates by the network provider for using internet connection which should be verified by the Viewer at his/her sole responsibility. In case of casting a vote while roaming in different circle/zone, additional roaming rates for browsing of the internet may be applicable. The Producer or the Platform shall not be held responsible for any such charges incurred by the Viewer.

GENERAL RULES AND REGULATIONS

• These Voting Rules including the Voting Mechanism as stated herein, are governed by the applicable laws of the Territory. The Viewer(s) participating in this voting must comply with all laws of the Territory. Any viewer who is held as a criminal or public enemy in the Territory is considered ineligible to cast a vote under these Voting Rules.
• The Producer and/or the judges of the Show reserve their rights with respect to the decisions of the selection and/or the nomination of the Contestants each week including but not limited to the declaration of the eventual winner and the same shall be considered as final and binding on the Show and its Viewers. The Viewers hereby understand that the Viewers do not have any right to dispute such decisions.
• In the event that there is any technical fault of the voting mechanism on the Platform, the Producer and/or the Platform has the right to re-open the voting lines at a later date subsequent to the removal of such technical hindrances or the Producer and/or the Platform has the right to terminate the voting lines for the week and eliminate the nominated contestants with the help of the Judges of the Show, at its own discretion.
• The Producer reserves the right to bring in new or replace the Contestants or Judges of the Show for any reasons whatsoever, as deemed fit and necessary by the Producer Further, the Producer shall also be entitled to re- introduce the eliminated contestants and/or re- introduce fresh individuals/contestants at any time during the Show.
• During the voting period, the Producer or the Platform is not liable to reveal the number of votes casted for each Contestant and the result of the votes declared shall be final and binding on the Viewers.
• The Producer and/or the Platform reserves the right to amend, modify or alter or terminate the Voting Rules at any time at its sole discretion without giving a prior notice to the Viewers. The Viewers are advised to appraise themselves on any changes at their own sole discretion. All changes and amendments can be found in the official website of the Platform. In the event any portion or clause of the Voting Rules become invalid or enforceable under the applicable laws, such portions shall be considered invalid and the remainder shall survive and be considered as valid and binding.
• The Producer and/or the Platform has the right to postpone or terminate the voting lines at any given point of time without any prior notice to the Viewer(s) and the same shall be considered as final and binding without any disputes against the decisions by the Viewer(s).
• The Producer and/or the Platform and/or its respective employees, officials, agents, authorised representatives, directors and affiliates shall not be held liable, in any manner whatsoever, for any personal injury/damage/loss/mental trauma/harm suffered by the Viewers in any manner whatsoever in connection to the Show and/or any aspect related to these Voting Rules. The Viewer also waives their right, to the maximum extent permissible under the applicable laws, to file any claims, class action suits, third party applications, civil and/or criminal proceedings in any courts or forums in the Territory to claim any damages or reliefs.
• Under no circumstances will the Producer or the Platform or its employees, agents and affiliates be liable for any consequential, indirect, special punitive or incidental damages or lost profits, whether direct or indirect, arising in any way whether in contract, tort (including negligence) or otherwise.
• The Viewer(s) hereby irrevocably acknowledges and agrees that the Producer shall have the sole and exclusive right including but not limited to intellectual property rights and other proprietary rights in and to the Show and all its components whatsoever.
• The Viewer(s) undertake that the Viewer(s) shall not violate the rights of any third party including but not limited to privacy rights, copyrights, trademark or any other intellectual rights; shall not upload, store, collect, transmit or cause the upload, storage, collection, transmission, of any information through the websites which violates any applicable laws, including, inter alia, belonging to another person; or is harmful, harassing, blasphemous, defamatory, obscene, invasive of other’s privacy, paedophilic, libellous, hateful, or racially, ethnically objectionable, disparaging, harms minors in any way, violates any law for the time being in force.
• The Viewer(s) hereby shall hold harmless and indemnify the Producer, the Platform, its affiliates, partners, sponsors, employees, officers, directors, agents or any other individuals appointed by the Producer and/or the Platform in relation to the Show and hold them harmless against any loss, claim, demands, costs and damages , judgements, expenses or liability including but not limited to legal costs arising out of or in connection with any or all claims that may be brought against the Producer, the Platform or by any third party in connection with the participation or winning the Show by Contestants. The Producer and the Platform shall also be held harmless against all claims and/or proceedings initiated against the Contestants and the Judges of the Show.
• The Platform is the only mode through which votes can be submitted by the Viewer(s). Any other third-party websites may provide information related to the Voting Period and Voting Mechanism however, the Platform does not endorse any other website collecting votes for the Show.
• All participants including but not limited to the Contestants, hosts, celebrity guests and the Judges of the Show hereby represent and warrant that they shall abide and follow the applicable laws of India especially the laws governing discrimination and racism, drugs, sexual abuse and harassment. Any person found violating such laws shall be eliminated or removed from the Show at the discretion of the Producer.
• The Producer further reserves the right, in its sole discretion, at any time and at any stage of the Show or the selection process, to reject or eliminate any participant/ Contestant who is deemed ineligible or for any appropriate reason as deemed necessary by the Producer including but not limited to acts of fraud, cheating, deception, or any other unfair practices or intending to annoy, abuse, threaten or harass any other participant or hosts or judges of the Show or has interfered with the proper conduct of the Show in the opinion of the Producer.
• The Platform hereby undertakes that all the personal information collected during the voting period shall be stored and shared in accordance with the Information Technology Act, 2000 and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology (Amendment) Act, 2008.
• These Voting Rules shall be construed and governed in accordance with the applicable laws in the Territory and in case of any dispute or other matter arising in reference to the Voting Mechanism and/or the Show shall be referred to a sole arbitrator and governed by the Arbitration and Conciliation Act, 1996. The venue for arbitration shall be Hyderabad, India and the language of arbitration shall be in English. All costs and expenses in relation to this arbitration must be borne by the aggrieved Viewer(s). Any interim reliefs under Section 9 of the Arbitration and Conciliation Act, 1996 shall exclusively be the courts at Hyderabad, India.
